This is an attempted termination of Katie Beckett Medicaid Benefits to an eleven year old child, injured by medical malpractice at birth. DWSS attempted to terminated her benefits unlawfully, however, ... the Nevada Supreme Court vacated the lower Court's decision for lack of jurisdiction, and remanded the case back to the hearing Officer. Once again, Gibbs won, and once again, DWSS appealed. This time, the District Court upheld the Hearing Officer's decision, creating first-level precedent in a case of first impression for the State of Nevada. It is hoped that the Court's decision will have wide-reaching consequences to those most in need of Medicaid benefits.
