OUTCOME: Sucessfully overturned trial result.
Helped mother recover custody of her child where father tried to use mother's admission of smoking outside the home as a reason to change custody. 931 N.Y.S.2d 159
OUTCOME: Successfully overturned trial court result.
Father sought to arrange visitation. The trial court used unsworn testimony from mother to deny father's application without providing father with counsel. The Third Department reversed the trial cour ... t holding that the trial court lacked a sound and substantial basis for its ruling.
OUTCOME: Successfully defended mother's result.
Mother had obtained a modification of custody because father had failed to engage in visitation and had alcohol and drug abuse problems. Father countered that Mother's living situation was not in the ... child's best interests. I was able to convice the Appellate Division that the Family Court had correctly analyzed the situation and that it would be better for the child if Mother exercised sole custody.
OUTCOME: Successful in obtaining support from father.
Successful trial result: the biological father of the child attempted to avoid financial support of child after acting to use his paternity to upset mother's marriage. Trial court rejected that effort ... and rejected a Law Guardian's argument to use equitable estoppel to prevent a support claim.
OUTCOME: Won reversal for client.
Successfully argued that our client's insurance broker had misinformed him about the coverage of an insurance policy and won coverage of business fire losses.
OUTCOME: Client forced to pay on letter of credit
While we were not able to reach the client's result, we were able to address the client's needs on an expedited basis. Here, the client had given a letter of credit to pay for goods which turned out t ... o be severely damaged. The case went from a state court action to a decision in the Second Circuit within six weeks.
