The petition provided that the defendant caused an accident when he failed to yield at a stop sign. Rather than taking the case to trial, our firm (representing the plaintiff) filed a motion for summar ... y judgment. The district court agreed and entered judgment in the full amount. The defendant appealed the case, but the Iowa Court of Appeals denied their appeal and affirmed the district court's ruling.

Juvenile law

In re B.S., a Juvenile (Iowa Court of Appeals, No. 12-1609)

OUTCOME: Affirmed

I was appointed by the juvenile court to represent the interests of the mother of an infant. The infant was removed from the mother's care shortly after the child's birth; the Department of Human Servi ... ces stated the reason as the mother's alleged drug use and her alleged continued involvement with the child's father against whom she had a restraining order. The juvenile court ordered that the parents complete mental health evaluations and substance abuse testing. Eventually the juvenile court terminated the mother's rights to her child because of the court's determination that she had not meaningfully complied with visits with the child, substance abuse training and mental health evaluations. As per the mother's request, I assisted her in appealing her case to the Iowa Court of Appeals. The Iowa Court of Appeals affirmed the ruling of the juvenile court.

OUTCOME: Affirmed (successful)

In order to fulfill an outstanding judgment against Defendant, Plaintiff garnished the intended inheritance that Defendant was to inherit from his deceased mother. Defendant unsuccessfully argued that ... the inheritance was exempt from collection because the house had been his mother's home originally. Plaintiff argued that although Iowa law does have protections for homesteads from creditors, it would not apply to a party who was inheriting a home and did not intend to live in said home. The district court found in favor of the Plaintiff and the Iowa Court of Appeals affirmed this decision.

OUTCOME: Affirmed (successful)

My client filed a claim in an estate for unpaid rent based upon a farmland lease. The estate counterclaimed that the corn bins built on the land should be removed from the land first. I argued that und ... er Iowa law, the bins became fixtures on the land that a tenant could not later remove. The district court agreed with my client's position, but the estate appealed. The Iowa Court of Appeals affirmed the district court's ruling.
