I successfully certified a national class on the claim of breach of the duty of good faith and fair dealing in a consumer contract. The defendant did not settle, but decided to try the case. The cas ... e was a bench trial and came down to a battle of the experts. Apparently, the judge found the defendant's experts more persuasive and ruled for the defendant. I include this loss -- of a national class action -- in my experience profile because I learned more from this loss than any victory achieved to date. Also, I think it's important to be forthright and frank about the cases that didn't turn out as we had hoped.

I represented approximately 10 farmers whose crops were devastated one season despite the representations from numerous pesticide companies that their products would work. I filed the case in state cou ... rt. Defendant removed the case based on fraudulent joinder and preemption of our claims by the Federal Insecticide Fungicide And Rodenticide Act ("FIFRA"). I lost the motion to remand at the federal district court level and appealed the case to the Fifth Circuit Court of Appeals. The Fifth Circuit overturned the district court on both (1) fraudulent joinder and (2) FIFRA preemption. Shortly after returning to state court, we settled the case. For years, this case was the seminal case on fraudulent joinder and preemption in the Fifth Circuit.
OUTCOME: Settled
