The Defendants delayed in disclosing before the statute of limitations that they blamed another physician for the Plaintiff's injury, despite being asked in discovery ahead of time. We added the alleg ... ed offender, knowing that we would likely lose the case on the statute of limitations. We did. We then sucessfully moved to suppress any reference by the Defendants to the fault of the alleged offender. It worked out well for us.
