On January 25, 2010 the SC Supreme Court, in a 3-2 decision, issued an opinion in this case holding that the SC Workers Comp Commission did not have the authority to pro-rate an injured workers award o ... ver her lifetime so as to minimumize her Social Security offset. A Petition for Rehearing was granted and I coordinated the writing of an Amicus Brief on behalf of the Injured Workers Advocates of SC. On October 25, 2010 the SC Supreme Court issued a unanimous opinion reversing itself and holding that the Commission did have the authority to order proration even over the objection of the defendants. Opinion # 26762.
