Curry v. Academy Pointe, Inc., et al.
Nov 17, 2017OUTCOME: $5.25 million verdict -- $750,000 compensatory damages, $4.5 million punitive damages
This was a housing discrimination and disability rights case under the Fair Employment and Housing Act and Unruh Civil Rights. My client is wheelchair bound, and he moved into a very large apartment co ... mplex with three elevators. There are no ground floor units, but my client wasn't worried because he assumed at least one of the three elevators would always be working. Unfortunately, he was wrong. One of the elevators was down for a year. Then, a second one started to go down fairly frequently, which was soon followed by the third one. Ultimately, my client was stranded outside and inside his apartment on numerous occasions. The case was tried to a jury, which returned a unanimous verdict completely in my client's favor awarding $750,000 in compensatory damages and $4.5 million in punitive damages. We're also entitled to an award of attorneys' fees, which will be determined by the judge after a motion is filed.
