OUTCOME: Appellate Court agreed with legal parent and adoptive parents that the Trial Court properly granted the stay of the termination proceedings; adoption was allowed to proceed.

Rebecca Bruce represented adoptive parents who petitioned to adopt a child that was a DCS Ward after legal parent consented to adoption. DCS did not agree with the adoption and wished to pursue involu ... ntary termination against legal parent. Legal Parent filed a motion to stay termination proceedings. Trial Court granted the stay and Guardian Ad Litem (GAL) appealed the Court Order staying the termination of parental rights proceeding. DCS, GAL, legal parent, and adoptive parents all participated as parties in the appeal, filing briefs.
