This was a mortgage fraud case. The client was a homeowner whose house was literally stolen from him by a criminal broker who forged the title deed and a loan application. As a result, the house was ... transferred to a third party, and the equity sucked out of the house by a new loan. The client was then sued for foreclosure, by the new lender, with whom he had never done business. We counter-sued every major institution involved in the matter. We ultimately received a large settlement from two of the lenders.
OUTCOME: $1.3 million judgment
This was a breach of contract and fraud case. Our client sold a motel in Parker, Arizona to the defendant, and took back a note secured by a deed of trust. The defendant refused to pay on the note, r ... efused to give back the hotel and charged our client with fraud. In a one week trial, we prevailed on all issues. We obtained a $1.3 million judgment, and foreclosed on the property.
