N/AOUTCOME: We settled the case for a confidential amount representing the majority of the disputed life insurance coverage
I recently settled a group life insurance case that had been denied because the insurance company said that my client failed to return an Evidence of Insurability form (regarding medical history) that ... was required for “spouse-life insurance” coverage. When I requested information from the insurance carrier and employer, however, we discovered that no one had ever informed my client that such a form was required. In fact, the employer had sent a “confirmation of coverage” and had billed my client for the premiums on the spouse life coverage (even after the spouse had passed away & after the insurance company had denied the claim). We filed suit in federal district court, and after considerable discovery and depositions, we settled the case for a confidential amount representing the majority of the disputed life insurance coverage.
