The Defendant was accused of Driving Under the Influence. An Officer followed the Defendant's vehicle and observed the vehicle leave its lane of travel on several occasions. The Officer than perform ... ed a traffic stop and had the Defendant perform standard field sobriety tests. The Defendant was then taken Gettysburg Hospital for a blood test. The Gettysburg Hospital blood test stated that the Defendant's Blood Alcohol Concentration was .231%. At trial, a Jury convicted the Defendant of DUI with a blood alcohol content of above .16%. However, we were able to successfully appeal this verdict and the trial court awarded a new trial. Mr. G was charged with Driving Under the Influence Highest Rate of Alcohol, Driving Under a Suspended License, Careless Driving, and Failure to Report an Accident. This was Mr. G’s fourth DUI within t ... en years and his blood alcohol content was .195%. This case arose out of an accident Lower Swatara Township. There was a witness that saw Mr. G driving the vehicle. Mr. G drove his vehicle back to his home in Middletown. Shortly thereafter the Middletown Police entered his home without a warrant. Attorney Tim Barrouk was able to successfully argue to Judge Lawrence F. Clark that the Middletown Police were not in hot pursuit of Mr. G's vehicle and therefore did not have the authority to make an arrest without a warrant out of their jurisdiction pursuant to the Municipal Police Jurisdiction Act. Additionally, Judge Clark determined that even if the Officers had the jurisdictional authority to make the arrest, they did not have sufficient probable cause to effectuate a lawful arrest. The Commonwealth withdrew all charges based on the suppression of evidence.
