State v. Webb

OUTCOME: Not Guilty in 14 minutes

Mr. Webb was accused of Possession of Firearm by a Felon. His estranged girlfriend reported to the police that he had a shotgun in his closet. The police searched and found a gun there. At trial, we ... called Mr. Webb's Probation Officer who testified that he had searched the house a month earlier and found no gun. We also showed the jury that the detective and police officer who investigated did not mention an alleged confession in reports written at the time of arrest, but added them in supplemental reports written 14 months later, about 10 days before trial.

DUI and DWI

State v. Bowers

OUTCOME: The jury hung on the DWI and the State declined to try the case a second time. Mr. Bowers was convicted of the lesser charges saving his right to drive and his job.

Mr. Bowers was accused of Driving While Impaired, Failure to Stop of a Red Light, Driving While License Revoked, and Hit and Run with Property Damage. Mr. Bowers seemed impaired to the police who inve ... stigated, seemed argumentative, and refused the requested breath tests. We succeded in a Motion to Suppress showing that the police did not allow Mr. Bowers to bring in a witness to watch him take a breath test. We argued the that the State did not have enough evidence to prove impairment especially given that Mr. Bowers had just been in an accident and had not received medical treatment.

OUTCOME: Murder dismissed. Ms. Bryant plead to a drug charge for which there was overwhelming evidence.

Sheila Bryant, an admitted small-time drug dealer, shot and killed a man as he approached her front door. She faced a murder charge. We were able to convince the prosecutor that the shooting was in se ... lf-defense. The victim angry that Ms. Bryant had provided low quality drugs, had smashed Ms. Bryant's windshield and threatened her with severe bodily injury as he approached her screen door.

OUTCOME: Not Guilty

Mr. Sinclair was one of four young men accused of a racially motivated Assault Inflicting Serious Injury with a Deadly Weapon with Intent to Kill at an International House of Pancakes in Fayetteville, ... NC. The victim was beaten into a coma from which he will never recover. The police arrived only after the beating was long over. We were able to show the jury that Mr. Sinclair was inside the restaurant when the beating occurred and that the guilty parties had long since left when the police arrived.
