The State alleged Defendant had violated terms of his probation. At hearing, Attorney Little argued that Defendant's probation had been previously unlawfully extended and that the Court lacked jurisdic ... tion to revoke Defendant. While the trial court erred in its opinion, the North Carolina Court of Appeals agreed with Defendant's position and reversed the trial court's order, including the trial court's finding that Defendant willfully violated his probation.

The Court of Appeals found in favor of the defendant who was represented by Mr. Little at hearing. Argued by Christy E. Wilhelm and Benjamin G. Goff, on appeal, the Court of Appeals found that, as Mr. ... Little Argued at hearing, the State failed to provide sufficient evidence that the Defendant had received written notice of the conditions of her probation. The Court noted that "oral notice is not a sufficient substitute for the written notice" required by state statute. The Court of Appeals vacated the lower Court's judgment.
