Recently recognized in NC Lawyers Weekly as the 6th largest verdict/settlement of 2009 for the state of NC. This matter was the result of an evacuation of an estimated 17,000 people when the EQ Plant ... in Apex, NC caught fire and released a toxic plume. A case of first impression in NC where the court allowed recovery for economic losses in tort without any physical injury or property damage to the claimants. The ruling stated that a cause of action did exist on the basis that it was reasonably foreseeable that the failure to properly handle, transport and dispose of chemical oxygen generators could result in a fire and explosion that would require evacuation of the area to preserve health and safety.
