OUTCOME: Relatives and other interested parties who suspect fraud or undue influence on a testator have increased rights to challenge devises and may do so without challenging the entire Will.

Two interested parties sued by Caveat to challenge an unusual $300,000 devise to non-relatives, without challenging the entire Will. When their challenge was dismissed with the trial court judge rulin ... g only an entire Will could be challenged, the parties appealed, and attorney Harry Gordon won a unanimous decision allowing the challenge to only the $300,000 devise based on claims of undue influence as to that specific devise only.

OUTCOME: Creditor/victim prevailed in Supreme Court. Relief in bankruptcy is now limited to "honest but unfortunate debtors."

Gordon v. New York State Bar, 48 N.Y. 2d 266, 397 N.E.2d 1309, 422 N.Y.S. 2d 641 (1979)

OUTCOME: Attorneys have the constitutional right to seek admission in New York without first moving there.

Attorney Gordon passed the New York State Bar but was denied admission because he moved to another state prior to swearing in. He sued and New York's highest court ruled it was unconstitutional, under ... the privileges and immunities clause of the US Constitution, for the State Bar to deny him admission to practice law in New York solely based on the fact that he was a resident of another state. This was the first of a number of decisions so holding, including a US Supreme Court decision, Supreme Court of New Hampshire v. Piper.
