During the course of pret ... rial litigation, lead counsel Michael J. Skinner and Ashly R. McGarity effectively raised reasonable doubt about the victim’s credibility. After a thorough investigation, Skinner Law Firm uncovered evidence that contradicted and impeached the victim’s story. Counsel presented this information to the District Attorney’s Office. Based upon this new information the DA’s Office withdrew all felony and misdemeanor charges. The client subsequently agreed to a plea deal to a (summary) harassment offense.

OUTCOME: Suspension Overturned

Client was arrested for DUI and subsequently transported to Phoenixville Hospital for chemical testing (also known as a blood test.) While at the hospital Client refused to submit to the chemical test. ... Thereafter, PennDOT suspended the Client’s driver’s license for one year. Skinner Law Firm filed an appeal of the Client’s license suspension, and successfully argued that the Client was not properly advised of the ‘Implied Consent Warning.’ The Implied Consent Warning is a warning that the police officer must give to a person (being requested to submit to chemical testing) that there driver’s license will be suspended if he/she does not submit to the test. Since the Client was not properly advised of the consequences of refusing the test, the Court agreed that the Client did not knowingly and voluntarily refuse to the test. As a result, the license suspension was overturned.

(A Nolo Contendere Plea is a plea, but without admitting guilt.) As part of the plea agreement, the Client avoided a prison sentence and having to register as a sex offender. Client received seven years of probation.
