State v. Gonzalez
N/AOUTCOME: Not guilty verdict after a jury trial.
Ms. Gonzalez, a US citizen from Puerto Rico, was pulled over and charged with DUI based almost exclusively on the fact that her tag light was out. A Spanish speaker, Ms. Gonzalez had a difficult time ... understanding the field sobriety test instructions which were given to her in English, despite the fact that the officer spoke Spanish. The officer also made several mistakes during the tests such as leaving his police vehicle flashers on and failing to designate a clear line on which to perform the walk and turn test.
