He was the passenger in the vehicle of a driver who allegedly attempted to rob an individual when that person pulled ... out their own firearm and shot him. Our client was alleged to have removed a sweatshirt and a mask and left the scene before police caught him. At the preliminary hearing, Brian and Suzanne were able to destroy the police allegations step by step and demonstrate that there was actually no evidence that our client had participated in the robbery. In fact, he never had a gun, he never left the car, and he only ran away when the alleged victim shot at him. The Judge agreed and found no probable cause for the case to continue.

At the arraignment, the State tried to make a plea offer, but Mr. Tevis provided the State a copy of the motion. Once the prosecutor reviewed it, he dismissed the case and agreed it would be removed from the client's record.

We were able to expedite the teletype cancellation to the Broward County Sheriff all within about 3 hours. Client released.

When police raided the house with a search warrant they found a firearm in the living roo ... m and some cocaine in the toilet. Everyone in the common area was arrested. Although the case had not been indicted yet, parole was moving to revoke his parole. We had an initial parole hearing and they continued it for a final hearing down at Jackson. We put up our case, argued a recent Court of Appeals case was on point, and the parole board listened. He was continued on parole, the parole hold was lifted, and we were able to get him released on bond.
