My client was arrested, but he ... refused to take the breath test. Police obtained a search warrant to draw blood out of my client to measure the level of alcohol in his system. The blood test results indicated a blood alcohol content of 0.103 grams (over the legal limit). Motion to suppress evidence was filed to challenge the constitutionality of the police actions.
