My client, Baus, a Polish Company, was sued in the Southern District of Georgia for alleged breach of contract related to fees for an infusion of capital by investors. I argued that forcing my Polish ... client to litigate 4,800 miles from its home country was unfair and that the Plaintiff had not complied with requirements of the Hague Convention. Ultimately the Court agreed and dismissed the case.

Brock v. Yale Mortgage Corporation 287 Ga. 849 (2010)

OUTCOME: The trial court ruled against my client; I appealed and had the trial court's decision Reversed (we won on appeal).

The trial court granted summary judgment against my client, Mr. Brock, and awarded Yale a security interest on the entirety of his house after his (now ex) wife forged a deed in order to refinance the ... mortgage and cash out equity in the marital house. On appeal, the Georgia Supreme Court reversed the trial court and held that Yale could not acquire a security interest in the entire property as a bona fide purchaser because the deed was forged. The Georgia Supreme Court overruled two earlier cases in order to reach a favorable result for Mr. Brock.

Submitted an Amicus Curiae brief on behalf of a lender (and numerous title insurance companies) that was denied its right to equitable subrogation in the trial court. On appeal, the Georgia Supreme Co ... urt reversed the trial court on this issue and held that the lender was entitled to equitable subrogation.
