OUTCOME: Client's motion for summary judgment was granted, finding no coverage under a claims-made policy for a nursing home wrongful death
OUTCOME: Following a three-day bench trial which I second-chaired, we obtained a full defense verdict against the agents’ bad faith counterclaim and were awarded 100% recovery on our indemnification claim, in addition to an award of attorneys’ fees and costs.
In the KnightBrook matter, I was counsel of record for Defendants KnightBrook Insurance Company, Knight Management Insurance Services, and National Specialty Insurance Company. The plaintiffs filed cla ... ims for breach of contract and bad faith and were seeking to collect an $8 million stipulated judgment from our clients following an underlying personal injury case arising out of a motorcycle accident. The case involved complex issues relating to agency and the reasonable expectation doctrine. Our firm negotiate a very favorable settlement for our clients with the plaintiffs and later represented KnightBrook and Knight Management in recovering the amounts paid toward settlement from the co-defendant agents at fault.
OUTCOME: Navigators’ cross-motion for summary judgment was granted and the Court awarded Navigators its attorneys’ fees and costs. Our firm is currently defending the award at the Ninth Circuit Court of Appeals.
Navigators issued a commercial general liability policy to a framing contractor that was sued after one of its employees left a company picnic intoxicated and drove the wrong direction on highway, kill ... ing both himself and the minor-driver of the other vehicle. Our firm was retained to provide coverage advice to Navigators in connection with an underlying wrongful death lawsuit. After our firm successfully settled the claims against the insured, we drafted the complaint for equitable claims seeking reimbursement from the insured’s commercial auto carrier, which had refused to participate in the defense or settlement.
OUTCOME: Client's motion for summary judgment was granted, and it was awarded fees and costs
OUTCOME: Employment discriminination case dismissed by Arizona Federal Court for lack of personal jurisdiction and affirmed by Ninth Circuit.
OUTCOME: Several other defendants filed successful motions for summary that were later overturned by the Ninth Circuit. In contrast, the judgments entered in our clients' favor were all satisfied.
In this insurance contribution action, our firm was counsel of record for defendants Northland Insurance Company and St. Paul Guardian Insurance Company. The coverage action involved more than twenty i ... nsurers and the litigation had been broken down into three phases. Our firm drafted and argued dispositive motions on behalf of our clients and obtained summary judgment in our clients' favor in Phase 1.Summary judgment was granted in our clients' favor, along with an award of attorneys' fees and costs.
