OUTCOME: The Sixth Circuit Court of Appeals reversed the judgment and found in our client's favor.

Our client insurance company contested liability under an excess insurance policy for punitive damages arising from a wrongful death case against their insured. The insured filed a declaratory judgmen ... t claiming the policy was ambiguous because the policy did not expressly disclaim liability for punitive damages but relied on allegedly ambiguous "follow form" provisions which adopted exclusions and coverage provisions from two underlying layers of coverage. The US District Court in Nashville Tennessee agreed with the insured and ordered the insurance company to provide coverage for punitive damages. We appealed the ruling along with another firm working on the matter.
