OUTCOME: My client won on appeal
In this post-divorce case, the trial court found Mother in criminal contempt based upon 16 year old daughter slipping away at night in order to avoid going to visit her Father. Judge found Mother in C ... ontempt and incarcerated her. I appealed the case for Mother, and the Court of Appeals overturned the wrongful finding of criminal contempt.
OUTCOME: My client maintained primary custody of children, and Father was restricted from attempts to convert his children, unless the children initiated interests in his beliefs.
In this post-divorce matter, I represented Mother in custody modification matter. The primary focus of the hearing was that after the divorce, the Father converted to the Jehovah's Witness religion. ... He tried to convert the children from their Baptist faith, which resulted in psychological and emotional stress and anxiety for the children. The Trial Court forbid the Father from initiating conversations and attempts to persuade the children to convert. We were upheld on appeal, when the Tenn Court of Appeals found that the Judge did not issue an unconstitutional order because the children's best interests overbalanced the right to freedom of religion.
OUTCOME: Client's conviction was overturned
My client was convicted of a felony case after a jury trial. On appeal, the conviction was reversed after I proved that the juror foreman concealed information that reflected a lack of impartiality.
