OUTCOME: Trial Court's judgment affirmed

Served as trial counsel in case wherein the Tennessee Supreme Court ultimately defined that the term "wage" in Tenn.Code Ann. § 50-6-241(a)(1) to mean the hourly rate of pay for an employee who is comp ... ensated on an hourly basis. The Court found that the statutory cap under § 50-6-241(a)(1) did not apply and hence client’s compensation was not capped since the employee did not have a meaningful return to work.
