Charges for Highest Rate DUI (BAC .16+) Dismissed by the Lower Court

Ms. M was stopped by the police and her roadside breath test revealed a BAC Level over .16. Her possible penalties if convicted included a one year license suspension, up to 60 days in prison, and up ... to $5,000 in fines. After hearing Attorney McShane's arguments on behalf of Ms. M, the Honorable Judge Day dismissed all of these charges. Concurrently, Ms. M was facing a second docket with the same charges in which Attorney McShane also succeeded in getting dismissed.
