Ralph Sparkman sold his business to Richard Boren and secured a loan by a contract and a promissory note. The contract prohibited Boren from selling the business without an agreement in writing from S ... parkman. Boren sold the business to a third party who was supposed to make payments to Sparkman on Boren's behalf. Boren never received permission to sell the business from Sparkman. The third party abandoned the business and the assets were seized by the franchisor. Suit was brought against Boren and a money judgment was awarded to Sparkman in excess of $70,000.00.

Mr. Fisher had attempted to convey his home to his two children in his old age but they declined. Some time later, Mr. Fisher became ill and ultimately died and his property passed to Mr. Rogers. Mr. Fisher's children filed a lawsuit against Mr. Rogers alleging that the transfer of property was fraudulent and that Mr. Rogers used undue influence and was in a confidential relationship with Mr. Fisher.
