This case arises out of the alleged wrongful death of an 81 years old woman who died at her former residence after being discharged from the hospital. She was driven to her former home by a taxi driver ... as a result of a voucher that was presented by the hospital. The plaintiff claims that Ms. Gibson should have been taken to the place stated on the voucher instead of the place where she directed the cab driver to take her (unbeknownest to the driver, her former residence). Further, plaintiff claims that the driver knew or should have known that Ms. Gibson was incompetant. Defendant won on summary judgment by showing that the driver had no notice of the alleged incompetance. Further, there was no evidence that the driver's actions lead to Ms. Gibson's apparent cadiac arrest.
