OUTCOME: Case settled after appeal to Tennessee Supreme Court Special Workers' Compensation Appeals Panel

Client was injured at work when she was offloading stacked boxes on a factory line. She injured her shoulder, neck, and also had developed severe carpal tunnel syndrome in both arms after years of wor ... k on a line. Her employer denied that she was injured. Client's doctors, on the other hand, performed diagnostic testing that revealed severe carpal tunnel syndrome in both arms, in addition to, tendonitis and bursitis in her shoulder. Additionally, her doctors found clinical evidence of cervical radiculopathy. After a trial, the judge awarded Client past unpaid medical benefits, past unpaid temporary disability benefits, and permanent future disability benefits. The employer and its insurance company appealed to the Tennessee Supreme Court. However, before the Court heard the appeal, the case was resolved by settlement.

OUTCOME: Case settled after arbitration

In February 2009, Mother, her two children, and a friend were involved in a car crash when the vehicle driven by Mother was hit head-on by a drunk driver. The defendant driver left a restaurant after ... allegedly consuming large quantities of alcohol. Mother was killed as a result of her injuries in the wreck. Her two-year-old son sustained post-traumatic left sixth nerve palsy and had medical bills totaling more than $32,000. Her five-year-old daughter sustained multiple hematomas to her abdominal and pelvic areas, bilateral pulmonary contusions with bilateral pneumothoraces, a liver laceration, left shoulder AC separation, and a left clavicle fracture and had medical bills totaling more than $25,000. The passenger friend was also injured in the wreck. Lawsuits were filed for the wrongful death of Mother, the injuries to her two children, and the fourth vehicle passenger (who was represented by separate counsel). Arbitration was conducted and the arbitrator determined damages were $6,700,000 for the wrongful death of Mother, $1,250,000 for personal injuries to the two-year-old son, and $250,000 for personal injuries to the five-year-old daughter. Based upon the arbitration results, all claimants received a pro rata share of the total insurance policy limits for the restaurant as well as the uninsured motorist carrier, a combined $1,500,000.

Client injured his shoulder at work and required surgery to repair his rotator cuff. He was able to return to work following his injury; however, his employer failed to pay him for his time off work f ... or the surgery. Client also sustained permanent impairment to his shoulder even after surgical intervention. At mediation, we recovered back-due disability benefits for his time off work for the surgery, in addition to, permanent disability benefits for the permanent impairment to his shoulder.
