Defendant was found "not guilty" of felony DUI (with 3 priors). This was a retrial after the jury hung 10-2 for guilty last September. Defendant rear-ended a stopped vehicle in unincorporated Jeffer ... son County where a traffic signal was out due to a power outage. Officer smelled alcohol and administered roadside test for horizontal gaze nystagmus, claiming client showed 6 of 6 clues. Defendant thereafter refused to participate in remaining voluntary field sobriety tests. When he got to the police station, the breathalyzer machine malfunctioned. Defendant refused to go to Golden for retesting. We were able to prevent a refusal instruction under the circumstances and argued that without the test result, the State was simply unable to prove their case beyond a reasonable doubt.
OUTCOME: Driver's license NOT suspended.
Attorney General agreed to set aside 2-year driver's license suspension in exchange for dismissal of petition for writ of mandamus.

The client, who is an attorney, had entered a no contest plea to possession of a controlled substance with a firearm. On appeal, Michael Becker argued that trial court erred in denying the client's mot ... ion to quash the search warrant and suppress evidence obtained from a search of the client's house, pursuant to Penal Code section 1538.5. Michael Becker argued that once information gathered during the unlawful protective sweep was properly excised from the search warrant affidavit, there was no probable cause to support a search of the client's residence. Michael Becker also argued the trial court should have excised statements the client made during the client's unlawful detention, and the sole remaining support for the search warrant—the presence of a stolen vehicle in the client's driveway—did not establish probable cause to search the client's house. The appellate court agreed and reversed the trial court's judgment. The court remanded the case back down to the trial court to allow the client to withdraw the no contest plea and for the trial court to vacate its order and grant the motion to quash and to suppress the evidence gathered during the search of the client's house.
OUTCOME: BATTERY DOMESTIC VIOLENCE CHARGE DISMISSED.
Client was charged with battery domestic violence. When the victim failed to show up a trial, the state dismissed the charge. Now client is free to pursue a record seal and keep his guns.
OUTCOME: SEXUAL ASSAULT AND KIDNAPPING CHARGES DISMISSED
Client was facing a possible life sentence for two charges of sexual assault and a charge of kidnapping. After only one and a half months of negotiation, the prosecutor dismissed all charges.
OUTCOME: NOT GUILTY of willful deliberate and premeditated attempted murder.
At trial, defendant was found "not guilty" of willful, deliberate and premeditated attempted murder. After preliminary hearing, the judge gratuitously found that defendant "was guilty beyond a reaso ... nable doubt". The case was sent for trial to the same judge but was removed to a different courtroom after the defense filed an affidavit of prejudice against the judge. The defendant was ultimately found guilty of attempted voluntary manslaughter
