Client was an entrepreneur that allegedly defaulted on a line of credit agreement. She was being sued for over $30,000.00 by a debt buyer that claimed they purchased the account from the original lende...r, but failed to attach the full loan agreement or any assignments to their complaint. We filed a motion to dismiss based on failure to attach required documents to the complaint.

OUTCOME: Petition to Rescind Statutory Summary Suspension; GRANTED; Finding of NOT GUILTY on the DUI Charge.
Client was pulled over and charged with a DUI and various traffic violations, and received a statutory summary suspension of his driver's license. The arresting officer claimed the defendant was speed...ing, swerving from lane to lane, smelled of alcohol, had blood-shot eyes, and admitted to drinking.
We filed a petition to rescind statutory summary suspension and issued discovery requests on the state, which they failed to timely comply with. Ultimately, the statutory summary suspensions was rescinded, and client's driving privileges were saved.
We then proceeded to conduct a trial on the DUI charge. On cross examination, the arresting officer's testimony showed that in fact client showed relatively few signs of alcohol impairment, and that the officer could not be certain beyond a reasonable doubt that client was in fact impaired.
