The Plaintiff, Justin Farris, was injured due to the actions of an intoxicated driver. The Plaintiff's complaint included a count for reckless misconduct, in order to permit the Plaintiff to later req ... uest the court to allow the Plaintiff to ask for punitive damages at trial. The Defendant moved to dismiss the recklessness count, and the trial court granted the Defendant's motion. Mr. Nessler appealed the trial court's decision. The Fourth District Appellate Court agreed with Mr. Nessler, and reversed the decision of the trial court. The appellate court reinstated the count for reckless misconduct. As a result the case settled.
