OUTCOME: ABC permit reinstated with no fine

Ark. DFA-Alcoholic Beverage Commission suspended Good Vibrations' liquor permit for 30 days based upon an alleged interference with government operations claim by the Benton County Sheriff's office. ... We appealed the suspension, and after a Freedom of Information Act request turned up numerous emails indicating an organized attempt by the Sheriff's office to go after the permit holder for what appeared to be personal reasons the suspension was dropped and the permit holder was "warned" to not interfere with with government operations in the future.

A University instructor was cited for Public Intoxication after being stopped at 2:00 a.m for weaving while riding his bicycle up the hill on Dickson Street as it approaches Arkansas. The officer claim ... ed the instructor was belligerent, uncooperative, could not stand up without leaning on the bicycle, and smelled of alcohol. The officer did not perform any field sobriety test or administer a BAC test. The video showed the officer standing 10 feet from the instructor, that the instructor was not belligerent, but only asked why he was being stopped, and that he could stand up just fine while speaking with the officer.

OUTCOME: Not Guilty.

Report stated the officer observed the defendant stagger out of a bar, spin his tires, no tail light, and speeding. Video shows the defendant perform the Standardized Field Sobriety Tests correctly ... with only one clue each on the Walk and Turn and One-Leg Stand. The officer claimed that he showed all six clues on HGN, but did not show any vertical nystagmus. When the client blew a .07 the officer decided that the defendant must have been impaired on drugs and turned the defendant over to a "drug recognition expert" who was certain that the defendant was impaired. Drug test came back clean except for Lidocain (i.e. orajel).

Police report said the client made a wide right turn and almost struck another police vehicle. Video showed no bad/illegal driving and that the Standarized Field Sobriety Tests were not administered ... or interpreted correctly. Motion to Suppress all evidence was filed because of no probable cause based on no traffic violation.
