We represented a cemetery in an appeal that challenged a decision from the Circuit Court of Shelby County (Tennessee), which found that the cemetery violated Tenn. Code Ann. § 47-18-104(b)(12), (14) of ... the Tennessee Consumer Protection Act (Act) and awarded damages to appellees, mother and father. The cemetery alleged the mother and father's claim was barred by the statute of limitations and it failed to state a cause of action upon which relief could be granted.
OUTCOME: The Court of Appeals affirmed the summary judgment and imposed sanctions against the Borrowers for their frivolous appeal.
Borrowers sought review of summary judgment granted at the trial court level in favor of Lender (our client).
OUTCOME: Statute held unconstitutional, case remanded for trial on other grounds.
Case challenged the constitutionality of Tenn. Code Ann. § 6-51-102(a)(1) as invalid class legislation under Tennessee's constitution.
