Jan 15, 2009OUTCOME: Claimant Found Disabled from Application Date
Claimant suffered from R.S.D. He filed his claim and was denied by an administrative law judge. The A.L.J. found that the Claimant was a malingerer and was exaggerating his symptoms. We found an adm ... inistrative rule on R.S.D. which states that the symptoms can come and go, and the Claimant can be expected to have good and bad days. We obtained all of the Claimant's medical records and submited a brief to the Appeals Council. The Appeals Council remanded to the Office of Disability Adjudication and Review (ODAR), which assigned the case to a different ALJ for a hearing. At the hearing, the ALJ announced mid-way through the hearing that he had heard enough evidence. He did not question the vocational expert and issued a favorable decision 9 days after the hearing.
