There is no exception to the economic loss rule for parties outside the chain of ownership whose cause of action arises from an alleged defect in a product sold in a commercial transaction. III. The statute of limitations for breach of a manufacturer's warranty begins to run upon tender by the manufacturer to the original purchaser; subsequent purchases do not restart the running of the limitations period on the original warranty. IV. The statute of limitations for breach of a manufacturer's warranty serves a legitimate legislative objective and therefore does not unconstitutionally deprive a party of a remedy under a sales contract.
