Appellant-father challenges the district court's denial of his motion to terminate his child-support obligation on the basis that his disabled adult son now resides in a group home where his care would ... be publicly funded if he did not receive child support. Appellant-father argues that there has been a substantial change in circumstances rendering the existing order unreasonable and unfair and makes a variety of other arguments regarding the inappropriateness of his obligation.
OUTCOME: Reversed and remanded. The Court held that the district court did not abuse its discretion in limiting parenting time, but could not modify custody without an evidentiary hearing or award attorney's fees without permitting Appellant to respond.
