Breach of a noncompete & nondisclosure agreement. Represented employer and alleged breach of contract, tortious interference with contracts, and tortious interference with economic advantage. Obtained ... temporary injunction against former employee who took confidential info and went to work for competitor. Employee enjoined from working in metro-area in same field until Court Ordered otherwise. Injunction remained in place until case settled over one year later on eve of trial. Employee appealed during trial court case. After representing employer on appeal, Court of Appeals affirmed injunction and Employer won.

Amount owed by client homeowner to contractor under a penalty clause for terminating the contract was greatly disproportionate to actual damages, rendering the clause unenforceable. Damages sought by t ... he contractor were a lot greater than the amount that it would have received absent the contract termination, and it was almost double the value of the work it had actually completed. Therefore, the amount was unreasonable in light of the contract as a whole, the nature of the damages contemplated, and the surrounding circumstances.

Serving as attorney on appeal to Minnesota Court of Appeals resulted in decision that trial court abused its d ... iscretion when it excluded the testimony of defendant's expert witness, who sought to challenge the validity of the interview techniques and protocols utilized to conduct the interviews of the alleged victims, in prosecution for sexual abuse of children; testimony concerning the techniques of interviewing sexually abused children was not within the knowledge and experience of a lay jury.

Order was entered by the United States Bankruptcy Court for the District of Minnesota denying creditor's motion for leave to amend fraud-based nondischargeability complaint, and entering judgment in fa ... vor of Chapter 7 debtor on creditor's fraud-based claims. Creditor appealed. Mark was counsel on appeal to 8th Circuit Court of Appeals BAP, reversal of order denying Creditor's motion for leave to amend the underlying complaint against the Debtor and remanded the case to the bankruptcy court for further proceedings where judgment was promptly entered in favor of Creditor for full claim.
