The Plaintiff’s driver’s license was cancelled for 6 years due to alcohol violations. In the first case of its kind in Minnesota, Plaintiff sought to force the Minnesota Commissioner of Public Safety ... to issue a driver’s license so long as he installed an ignition interlock device. The Court agreed with the Plaintiff and found that the Commissioner of Public Safety had failed to fulfill its statutory obligation to provide an ignition interlock program and specifically ordered the Commissioner of Public Safety to provide a driver’s license to the Plaintiff, so long as he installed an ignition interlock device on his vehicle. This case lead to the enactment of new legislation in Minnesota that provided statewide availability of ignition interlock licenses to thousands of Minnesotans that were previously ineligible for any kind of driver’s license.
OUTCOME: Defendant won his Federal sentencing appeal
Defendant plead guilty to possessing counterfeit money and other charges were dropped. In the process of possessing the counterfeit bills, they were hidden. The government argued that his sentence s ... hould be longer for obstructing legal process. Defendant argued that it was double counting to punish him for obstructing legal process when the obstruction was the same conduct as the possession. The trial judge agreed with the government. The Federal Eighth Circuit Court of Appeals reversed and agreed that the double counting was impermissible. The Defendant was immediately discharged from probation by the court because of the ruling. U.S. v. Lamere, 980 F.2d 506 (8th Cir.)
OUTCOME: Plaintiff reinstated in school
