Plaintiff Schafer was injured when she swallowed a foreign object that was in a muffin she bought at a Perkins restaurant. The trial court granted summary judgment dismissing the case because Schafer ... could not identify the foreign object that injured her. The MN Court of Appeals affirmed the trial court's dismissal. The MN Supreme Court reversed the trial court and the Court of Appeals, and remanded the case for trial. The Supreme Court's decision clarified [and some say expanded] the law applicable to injuries from ingested food.
