Estate of Elenbark v Rack's Bar and Steve Evans
May 19, 2010OUTCOME: Verdict for Plaintiff in amount of $8,605,383.13 with the bar being found 75% at fault and the driver 25% at fault.
Mary Elenbark was riding on the back of her husbands motorcycle and was going home after going out for dinner, when a young man, who had just turned 21 years old, pulled his car out of a bar's parking ... and into the path of the motorcycle. The driver fled the scene, but was picked up by police. Video was obtained inside the bar It was claimed that the driver of the car was intoxicated and was knowing served alcohol while he was visibly intoxicated. It was also claimed that the video inside of the bar had been intentionally altered. Mrs. Elenbark died from her injuries a week after the accident. She left a husband and child.
