OUTCOME: The government agreed and reinstated the petition and approved the green card.

Mr. R was the beneficiary of a petition filed by his mother. When he came to us we let him know that although he was in the U.S. without documentation for many years, he was eligible to file for a gr ... een card under a special provision of the law - INA 245(i). However, by the time he was scheduled for an interview, the his petition had been terminated making him ineligible for a green card. We argued that the petitioner (his mother), had become a US citizen within the past year that the termination was in error.
