Application for Post-Conviction Relief Approved
Apr 26, 2012OUTCOME: Approved
My client had a very old, 1980's conviction for robbery. When my client tried to apply for a green card, the application was denied due to the old crime, which was a "crime involving moral turpitude" ... a deportable offense. We made an application to the previous court that convicted him, complaining that his constitutional rights were violated because he was not advised as to the immigration consequences of his plea, either by the Judge or an attorney. After a plenary hearing with the judge, the original conviction was overturned. The prosecutor, overwhelmed, decided to drop the case. My client will soon be applying for a green card without any criminal record!
