I represented Plaintiff Wife in a matrimonial action recovering $23,000 per month in pendente lite support. Defendant Husband failed to pay and fled the country after surrendering his passport to the C ... ourt and after the issuance of a Writ of Ne Exeat preventing Defendant from leaving the State of New Jersey. Defendant-Appellant then filed a motion for leave to appeal to be permitted to participate in the lower court action, which the lower court had previously denied based upon Defendant's non-compliance and violation of various court orders. The appellate division denied such motion based because Defendant was a fugitive from justice.
