Mr. Ervin was discriminated against because he was black. Upon being hired by defendant, he was placed to work next to a felon who almost immediately began harassing his because of his race. Over the y ... ear that followed, Mr. Ervin futilly complained to his manager, who joined in the discriminatory behavior, also referring to Mr. Ervin with racial epithets. Mr. Ervin was removed from his post and into small tire storage unit segregated outside the warehouse. After one year, Mr. Ervin's manager assaulted him by hitting him on the head with a sanitary disk which he picked up out of the men's bathroom urinal. He then proceeded to hit Mr. Ervin on the head with a dirty toilet brush while he was in the toilet stall.
