OUTCOME: DWI dismissed
Client was charged with driving while intoxicated as a result of a motor vehicle accident that occurred on the New Jersey Turnpike on January 16, 2013. State troopers were called to the scene by anonym ... ous callers indicating that they had witnessed the accident and had seen three men exit the vehicle and flee into the marshlands. When the police arrived they found a vehicle with extensive damage and began to search the surrounding area for the driver and passengers. Client was apprehended along with another individual. Client had a BAC of .15 according to the alcotest. During my preparation of the case, Client explained, through a Korean interpreter, that he was not the driver, but that the third unapprehend individual had been driving. The state troopers provided 9 motor vehicle video recordings from 5 different police cars. A review of these videos demonstrated that Client spoke virtually no English and seemed confused by all of the questions asked by the police. The videos seemed to contradict many of the statements made by the police on the scene. I conferenced the case with the prosecutor and argued that she would not be able to prove her case beyond a reasonable doubt and I pointed out several problems for the prosecution. She contacted the arresting officer and after discussing the case with him, she agreed to dismiss the DWI charge.
OUTCOME: Not Guilty
Client was charged with assault and harassment of his girlfriend on December 7, 2011. Mr. Client filed a cross complaint against girlfriend for assault and harassment. In preparation for trial, I su ... bpoenaed Client’s cell phone records to show dozens of phone calls from girlfriend to Client after the date of the alleged incident. In addition, through Client’s Facebook account we were able to print out over 40 text messages that girlfriend had sent to Client after the incident. I obtained numerous emails from girlfriend in which she threatened Client and also obtained copies of a small claims summons and complaint in which girlfriend had civilly sued Client for half of the security deposit on their apartment. At trial, I confronted girlfriend with all of this evidence on cross examination. At the conclusion of her on-trial testimony, I made a motion to dismiss the harassment count for failure to make out a prima facie case and my motion was granted. The Court found Client Not Guilty.
OUTCOME: DWI Dismissed
On January 29, 2012, Client was in his vehicle on the shoulder of Route 46 at 3:45 am trying to start his car which had stalled. Client friend was seated in the passenger seat. New Jersey State Trooper ... s pulled up behind Client’s car and approached him. They claimed to have smelled a strong odor of alcohol and had Client take a field sobriety test which he failed. Client told the police that while he was the registered owner of the car, he hadn’t been driving and that his friend was the driver. Client was brought to the police station where he refused to submit to an alcotest. Upon investigating the case and preparing the matter for trial, I made a motion to dismiss based on that fact that Client had not been the operator of the motor vehicle. I spoke extensively to Client who explained that while his friend was driving the car, the engine stopped running and the car drifted to the shoulder. He asked his friend to switch seats so that he could try to restart the engine. It was at this time that the police arrived. In order to corroborate Client’s version, I obtained records from the towing company which confirmed that the car could not be started as well as records from a transmission company confirming that the automobile needed a new transmission. I also met with the friend who confirmed Client’s version of events. I reviewed with Client the motor vehicle recording provided by the state police which showed Client seated in the driver’s seat, but not driving the vehicle. Prior to trial I sent the municipal prosecutor a witness list and a copy of the documents mentioned above. In his opening statement, the prosecutor moved to dismiss based on his inability to prove operation of the vehicle.
