The City and DOE were sued on behalf of a vendor. The vendor took pictures of students to sell to parents and for the yearbook. The vendor employed a photographer who plead guilty to endangering the ... welfare of a DOE child in 2007. In 2012 DOE found out that the photographer was still employed and in DOE school. The vendor was de facto debarred. The judge dismissed my article 78/1983 petition. The court of appeals ruled unanimously in my favor remanding the case in part to the DOE for a responsibility determination and in part to the judge for a determination of the 1983 case.
