OUTCOME: Won declaratory judgment for coverage and indemnification against one of the largest insurers in the world

Successfully prosecuted a declaratory judgment action against a large Italian insurer, in the Federal District Court for the Eastern District of New York. The insurer disclaimed coverage, alleging var ... ious jurisdictional and contractual defenses, all of which were successfully refuted. The Court compelled the insurer to provide coverage and indemnify the insured in connection with a product liability matter - the death of a body shop worker through the explosion of a compressor.

OUTCOME: The federal court action was tried to conclusion and all claims against my clients were dismissed by the trial judge.

Brandaid Marketing Corp. v. Biss Successfully defended in federal court a $21 million dollar action against a Hong Kong corporation and a securities attorney for alleged violations of the Securities ... and Exchange Act. Plaintiff alleged that that the Defendants had orchestrated an illegal takeover of a public company. Prior to trial, successfully argued (1) for the remand of a federal court claim to the Supreme Court of the State of New York for lack of complete diversity jurisdiction; and (2) against a preliminary injunction application, by reason of the Anti-Injunction Act, 28 U.S.C. § 2283. My clients won at trial. The Brandaid decision has been cited in several reference works, including Wright & Miller: Federal Practice and Procedure, Sections 3605, 3611 and 3612 (1984), and New York Practice Comm. Lit. In New York State Courts, Section 10:6, Class actions (2005).
