Harris Feldman represented the estate of a young man who was killed when his car was involved in a motor vehicle accident with a truck. Our client was killed when an inexperienced and untrained truck d ... river abruptly cut into his lane of travel from the shoulder. The initial police investigation determined that our client was at fault for the accident. However, working with an accident reconstructionist Mr. Feldman established that the police investigation was incorrect. Also, during litigation, Harris uncovered the fact that the defendant driver was never properly trained by his employer to drive a large commercial vehicle, and, that when the accident occurred the defendant’s license was suspended. Mr. Feldman also identified the fact that the defendant driver’s employer had violated several important Federal and State trucking laws which made them liable for the accident as well. Even though it was clear the plaintiff was not wearing his seat belt at the time of the accident, Harris Feldman was able to settle this case for $350,000.00 one month before trial.

Harris S. Feldman represented the estate and the father of a 16 year old girl who was killed when the driver of the vehicle drove into a telephone pole. The driver and front seated passenger claimed th ... at another 16 year old passenger jumped into the front seat - without warning - causing the accident. The teen who jumped into the front seat called our client’s father immediately after the accident. He arrived at the scene minutes after the crash, witnessing his daughter, still alive, bleeding and seriously injured. The defendants argued that the father’s claims for emotional distress caused by witnessing his daughter at the scene should not be allowed, but Harris successfully argued that the father’s claim should go forward. Harris partially settled the case prior to trial, and tried the case obtaining a verdict against the driver of the vehicle. The combined recovery for the estate and the father was $907,000.

Dennis Donnelly and Harris Feldman represented an 18 year old, brand new driver who sustained a permanent brain injury after being struck by a poorly designed and unsafe airbag, when it deployed from ... a low speed collision which she caused. Cars can be unsafe, at any speed, and thus legally uncrashworthy, when poorly designed safety devices cause rather than prevent death and brain damage in low speed accidents. Dennis, Harris, and Kris, their paralegal, have handled such claims for many years, and were able to prove after years of complex and expensive discovery and expert analysis, that a defective airbag on her first car will cause a high school "Miss Congeniality" winner to battle the aftermath of a closed head brain injury for the rest of her life. Their client was seat belted, and the police were shocked to find her in a coma after a 15 mile per hour impact. It was only after years of investigation and expert analysis that Dennis and Harris were able to prove that the airbag that was supposed to save her, actually caused her brain injury. Through extensive work with 3 different automotive airbag design and performance experts, Dennis and Harris were also able to discover that the manufacturer of the vehicle experimented with an over simplified airbag sensor design in an effort to save money; even though that same manufacturer used a better design in its other vehicles that would have prevented this young woman’s injury, by not firing the airbag upon impact at such a slow rate of speed.

Harris obtained a jury verdict on behalf of a 51 year old woman who was injured when another driver crashed into the back of her car. The crash caused a disc in her spine to herniate which caused her s ... erious pain. The defendant’s insurance company would only offer $30,000.00 to settle the case. At trial the defendant argued that Harris’ client’s injury was not that serious and that almost all of her complaints were related to aging of her spine and not the accident. The jury found that the crash did cause our client’s injury and awarded her $125,000.00.
