American Civil American Civil Liberties Union v. Ashcroft, 322 F. 3d 240 - Court of Appeals, 3rd Circuit 2003
Mar 06, 2003OUTCOME: Issuance of a preliminary injunction affirmed.
Counsel for Amici Curiae, The Publishers Marketing Association (PMA) in important Internet freedom of speech case. Court held that because the ACLU was likely to succeed in establishing that COPA was ... unconstitutional for being overbroad, it affirmed the issuance of a preliminary injunction. COPA's definition of "material harmful to minors" had impermissibly placed at risk a wide spectrum of speech that was constitutionally protected.
