FACTS OF THE CASE Prior to hirin ... g our firm, the client had retained another lawyer to defend him against a personal injury suit filed by the client's tenant. The attorney had stopped representing the client because he wanted more money to defend the claim. As a result, the client could not adequately defend the suit and was served with a judgment in excess of $140,000. It is important to note that our client was not actually responsible for the injuries sustained by the tenant as she was severely intoxicated at the time of the accident. Had our client received proper representation from his prior attorney, he would have been able to completely defined the personal injury action. RESOLUTION Upon receiving the judgment, the client hired the Law Offices of Peter J. Lamont to help resolve the judgment. The client wanted to sell his rental property in order to satisfy the judgment but there were a large number of issues that needed to be resolved with the property before it could be listed. The firm worked with the brokers and client to resolve all outstanding issues with the property. The house was listed and sold and the firm handled the closing. Separately, we were successful in negotiating a greatly reduced settlement amount. Thus, instead of paying the $140,000 judgment, we were able to reduce the total settlement payment to $50,000. This allowed our client to retain the bulk of the money from the sale of the property. The Law Offices of Peter J. Lamont has successfully defended a business client against criminal charges which included fraud, forgery, and theft by deception. FACTS OF THE CASE The firm's cl ... ient owned a local postage and shipping business. Wanting to move out of state, he sold the business to the purchaser. He provided all of the financial documents necessary for her to make an informed decision to purchase the business. The purchaser, a first-time business owner, agreed to purchase the business and our client stayed on for a few months to help her get set upend "learn the ropes." After a number of months operating the business on her own, the purchaser, who had not been nearly as successful as our client was with the business, attempted to invalidate the purchase of the business by claiming that our client had fraudulently induced her to purchase the business and that he had forged her signature on documents, along with other similar claims. Contrary to the purchaser's claims, our client had in fact, gone above and beyond by not only providing her with all of the financial documentation, but by helping her gain a better understanding of the business by working with her, for free, before he moved out of state. LEGAL PROCEEDINGS A criminal complaint was filed against our client by the state of New Jersey after probable cause was found to exist based solely upon the statement of the individual who purchased the bushiness from our client. Our firm was hired by the seller to defendant him against what he considered to be frivolous claims. After six months of discovery the case was tried. Attorney Dennison Marzocco, Esq., an associate of the firm, handled the trial and at the conclusion of the State's case, moved for a dismissal of all charges. The court, after hearing the testimony of the purchaser and the cross-examination of Mr. Marzocco, found in favor of our client and dismissed all charges against him. Attorneys Peter Lamont and Dennison Marzocco successfully defended one of its corporate clients against claims made by one of the companies former distributors. The lawsuit, filed in California Superio ... r Court, Orange County, sought damages against the firm's client in excess of $100,000. The complaint contained allegations sounding in breach of contract, fraudulent inducement and tortious interference with business. The firm filed a motion to dismiss pursuant to CCP 418.10 which was granted by the court.

The firm successfully represented tenants of an apartment building in Paterson, NJ against their landlord who had refused to make necessary repairs to the units which were severely damaged during Supe ... r Storm Sandy. The landlord had submitted insurance claims for the damage to the property for which he recovered over $250,000 from his carrier but refused to put any of the money towards the repairs. Through litigation the Firm was successful in requiring the landlord to make all of the repairs originally identified in his claims to his insurance adjuster.
